All of the services provided by The Gift Company are subject to the following conditions:
- This is a European retail site. Non-Euro residents may be subject to a non-sterling purchase/transaction fee applied by their bank/card provider.
- This promotion is serviced and administered by The Gift Company. These offers are not valid in conjunction with any other discount offer / promotional weeks may not be used by any company or individual involved in any way with its distribution. The Gift Company does not offer any warranty and is not accountable for any services provided by the resorts or hoteliers associated with this promotion.
- Please be aware no claims will be honoured or acknowledged outside these terms and conditions.
- When you purchase anything from us or give us any personal data as indicated above, we may need to collect information about you to process the transaction, fulfil your order and provide you with the services you expect then and in the future. This information may include, but is not limited to, details such as your name, your address, your phone number and your credit card details. This information will be kept secure and is bound by our confidentially codes.
- All accommodation at The Gift Company hotels are of a very high standard and applicants occupying such apartments are liable for any deliberate, or accidental, damage or loss. Some hotels may require a key deposit payable by a recognised credit card for all accommodation (refundable on departure) and damage will be charged to the credit card.
- The Gift Company does not accept liability for any changed, loss delays, injuries/deaths, accidents or dissatisfaction caused by occurrences and conditions beyond its control including, but not limited to, act of god, nature, sickness, strikes, local customs, law and politics, wilful or negligent acts and/or omissions of any other person of companies who are not employees or authorised agents of The Gift Company.
- If during the period of this offer, there is either change in the promotion criteria, or in your personal circumstances, the Terms and Conditions will apply, in that you, as the client, will not qualify for a refund or any form of compensation. Any changes to, or cancellation of a confirmed booking may result in either an administration charge or the loss of the holiday.
- When taking advantage of our flexible breaks, clients can book a maximum of 3 months in advance.
- When using a Gift Week, we require a minimum of 4 weeks notification prior to your travel date.
- During certain high seasons of the year the company reserves the right to charge a small supplement fee to offset the rise in accommodation costs incurred during these periods
- You undertake to us that the details you give to us are correct and in particular that the credit or debit card you are using is your own and that there are sufficient funds to cover the cost of the product or service. In order to ensure that the payment details are your own, we may ask you certain security questions such as the 3-digit CVV code on the reverse of your credit card.
- All arrangements are subject to the conditions imposed by participating hotels and The Gift Company do not accept responsibility for their faults or the negligence of others.
- Whilst on your break you will be required by the resort, hotelier or marketer to attend a products and services appointment, a time will be agreed with you on arrival or prior to your stay. During the appointment the marketing team will discuss with you their products and services. Please be aware you are under no obligation to buy or enter into any contract but you must attend the products and services appointment. Failure to do so without an agreed upon reason will result in you paying the full rental cost of your accommodation.
- Prior to all arrangements The Gift Company vets appointed resorts, destinations and associate companies. These The Gift Company holidays are planned in advance. If, in between the planning and holiday time, circumstances beyond The Gift Company's control change, The Gift Company reserve the right to vary and/or substitute the itineraries and any components of the holiday offer.
- The Gift Company has, and will, persevere to give optimum services by selecting and contracting high quality holiday resorts, agents and suppliers for their standards and credibility. The Gift Company reserves the right to substitute or provide alternative accommodation of a similar standard due to any unforeseen circumstances.
- The Gift Company book accommodation on a flexi break basis, which can only be organised on a to be arranged basis, subject to availability, against the resorts as advertised on our website, https://www.giftcomp.com. We will endeavour to place you in a hotel suitable to your requirements and reserve the right to offer no more than 6 different options for your break. Verbal claims from sales agents or alternative marketers are subject to availability and will only be honoured if that particular hotel can be sourced. The company reserve the right to offer suitable replacements in this instance
- Our discounted prices are acheived by purchasing inventory in bulk and in advance, with this in mind it is not possible for us to offer a refund once the promotion has been paid for.
- Unless we have your express consent, we will only disclose personal data to third parties if this is required for the purpose of completing your transaction with us. This is of course subject to the proviso that we may disclose your data to certain permitted third parties, such as members of our own group, our own professional advisers who are bound by confidentiality codes, and when we are legally obliged to disclose your data. You authorise us to contact you with future promotions.
- On all our flexible The Gift Company you may have opportunity if you wish to upgrade your standard of accommodation or extend your stay whether it is for an extra day or week. Please be aware a small booking fee will be implemented on any request.
- If, for whatever reason, it is necessary for you to cancel your accommodation you must contact customer services, no later than 5 days prior to your travel date, to make them aware of the cancellation. Failure to do so will result in you paying the full rental price on the accommodation you had reserved.
- You are required to activate your account, which can be done via the website and activated digitally or by signing/returning the required activation documents. We ask that you aim to complete your documentation at your earliest convenience. Please be aware we can only make your reservation for your break once we receive your completed documentation.

In order for us to provide any accommodation or accommodation quotes and to administer any breaks or queries , we may need to share your personal data with hotels, marketers and other travel partner participants.

What data do we collect?
The personal data that we may collect may include

Where you have provided your consent, you may withdraw this at any time. However, should you exercise this right, we may not be able to fulfil the holiday services requested by you, your holiday may be cancelled, or you may be unable to make a travel request.

How we may collect your personal data
We may collect your personal data from you engaging with us via social media, via third party sources of data collection or (with your consent) having your information provided to us to supply you with the benefit of our services due to using products of associated companies.
How we may use your personal data
We will use your personal data for our legitimate business interests and on the legal basis for the purpose of providing you with the provision of our services which include arranging and providing holidays and administration of holidays to which you are a party. We may also use your data in assisting you with any of your travel or booking requirements.
In some cases our company may use your information to supply you with information about special offers, upgrades, discounts and promotions via telephone, email, social media or text message.
We will only process your personal data on this basis and for the purpose of our and your legitimate interests, which are to provide you with the most suitable travel services.
We do not sell or supply any personal data to any third party and will disclose personal data only when required by law.
We also do not use personal data for any form of automated processing or decision making regarding any of our products and services.

In the performance of our legitimate business interests and in the provision of our services to you, in arranging travel based reservations for you, we may need to disclose your personal data to hotels, marketers, flight companies, transfer companies or other travel agencies including other travel related companies dependant on what elements of travel are booked.
